Ground breaking decision rendered

Jurisprudence in favor of an unpublished literary and artistic work used against a design subsequently registered at the INPI in France by a third party.

In addition to the ruling rendered in 1999 by the Court of Appeal of the United States of America's Federal Circuit of Courts in favor of copyright over patent; to the ruling rendered in Belgium in 1997 in favor of the copyright of Hergé's heirs over the unauthorized use of artistic drawings for commercial and industrial purposes; to the countless court cases won by Walt Disney Studio over the past several decades for similar wrongdoings (i.e. plagiarism), and above all to the international ruling rendered in 1987 in favor of French Professor Luc Montagnier's copyright over American Professor Robert Gallo's patent for the discovery of the AIDS virus; for the first time, a modest inventor has successfully used, in a court of law, an unpublished literary and artistic work (created in 1994) against the French equivalent of a Design Patent (U.S.) or Industrial Design (Canada) subsequently registered by a third party. This case confirms that a previously undisclosed creative work ~ i.e. one that remained secret ~ is nonetheless a legally valid anteriority (i.e. prior art) that can be used to annul a patent, subsequently registered by a third party on the same invention. The details of this case are quite revealing.

New book on intellectual property published

Enfin la propriété intellectuelle à la portée de tous! a new book written by Michel Dubois & Co was published in 2004.

Presently, it is available only in its original French version. It provides an in-depth understanding of intellectual property issues, including many of the benefits of the Intellectual Passport C B.

Synopsis: This book explains how access to intellectual property can become more easily available to a wider number of people (i.e. more democratic…). It shows what the author of a new commercial idea, or innovative service concept could do in order to demonstrate and benefit from ownership of his or her intellectual property internationally. It further elucidates how an inventor can do the same thing without having to incur the cost of obtaining a national patent in each country around the world. In addition, all this is available for a price that is, for the most part, completely affordable and well within the means of a great many people. The method proposed also includes additional benefits such as a way to safeguard proprietary secrets, a workable business plan and a selection of useful contracts, all of which serve to demonstrate the intent to commercialize the invention or service concept. In effect, all the pertinent aspects relating to intellectual property (philosophical, economic, legal, etc.) are discussed in this work, which is a unique treatise on this subject.
